This Statement of Warranty Terms and Conditions (“Warranty”) is made between WatersaversTurf and the purchaser (“Purchaser”) of the synthetic turf products (“Products”). By accepting the Product(s), the Purchaser agrees to be bound by and accept these Warranty Terms and Conditions.

Limited Warranty:

General provisions of this limited warranty apply to ultraviolet degradation and manufacturer defects and does not apply to damage incurred during installation, improper underlay, blade crushing, willful or negligent abuses, or damage by machinery or equipment. Normal wear and tear shall not be considered a manufacturing defect and is not covered by this warranty.

All Product warranties begin on the date of purchase and are valid only if the turf is maintained as per the manufacturer’s recommendations. WatersaversTurf shall not be liable for any indirect, incidental, punitive, or other similar damages including, but not limited to loss of profits or revenue, economic loss, or other goodwill, even if such damage was anticipated. WatersaversTurf is not liable for the removal, disposal, or installation costs, including labor costs, with defective or replacement turf.

Warranty Period:

WatersaversTurf warrants our residential landscape synthetic turf with an 18-year limited product warranty. Commercial, high-traffic, sports applications, and putting greens are for a 10-year limited product warranty. All Product warranties begin on the date of purchase and are valid only if the turf is maintained as per the manufacturer’s recommendations. The pro-ration schedule is as follows:

• Residential Turf (18 years): 100% (Years 1-8), 50% (Years 9-12), 25% (Years 13-18)
• Commercial, High-Traffic & Sports Use including Putting Greens (10 years): 100% (Years 1-4), 50% (Years 5-6), 25% (Years 7-10)

Warranty Coverage:

In the event of warranty issues covered by the Limited Warranty, WatersaversTurf will, at its sole discretion, offer one of the following:

1. Provide a replacement Product of similar quality for the defective area only. Replacement of the area is for the synthetic turf product only, excluding any and all costs associated with the installation, including but not limited to installation supplies, inconvenience, labor charges, etc.
2. Provide a credit for the cost of the defective area only. This credit shall only apply to the affected area of the synthetic turf product. The Limited Warranty excludes all implied warranties, and WatersaversTurf shall in no event be liable for a breach of warranty in any amount exceeding the invoice price of the turf.

Exclusions:

This limited warranty is in lieu of all other warranties, expressed, statutory, or implied, including but not limited to, implied warranties of the merchantability and fitness for a particular purpose. Furthermore, this warranty excludes coverage for the following conditions:

1. Failure to properly maintain, protect, and/or repair the turf.
2. The Turf product is subject to normal wear and tear. Normal wear and tear, including matted down or twisted blades, is not a manufacturing defect and therefore is not covered by this warranty.
3. Damage caused by reflection/external heat source (melting) or other flammable materials. Such reflection sources include but are not limited to windows, vinyl fences, metal blocks, concrete/stucco walls, etc.
4. Visual lines caused by variations of the color of yarns and manufactured tufted stitch lines are not considered a defect as there is no deterioration of actual yarn and it is a common occurrence among all tufted products.
5. Damage caused by faulty installation or installation issues. This includes wear or abrasion resulting from an inadequate sub-base.
6. Damage caused by chemicals, herbicides, pesticides, adhesive backing, improper cleaning methods, or neglect, such as failure to address calcium buildup.
7. Damage from accidents, vandalism, abuse, burns, neglect, and improper installation.
8. Rolls of artificial turf where the backing of the turf is not covered and is exposed to sunlight.
9. Natural disasters (fires, earthquakes, floods, hurricanes, etc.), or other conditions beyond WatersaversTurf’s control (vehicular traffic, dogs, etc.).
10. Damage that occurs during the shipping/transportation process. All shipping claims must be filed against the freight company.

Limitations on Liability:

The Purchaser is responsible for inspecting all Products for defects, Product style/SKU accuracy, and dye lot before installing, cutting, or altering the Products. WatersaversTurf shall ensure that the Products are free from shortages, defects, or non-conformities if and only if the Purchaser notifies WatersaversTurf prior to installation or altering the Products. This warranty is only for the original purchaser of the Products and is non-transferable.

How to File a Claim:

To file a warranty claim, submit the following information:

1. Watersavers Original Invoice with matching identification of Purchaser
2. A detailed description of the issue
3. Photo evidence of the defect (minimum of 3 images)
4. Customer name, address, and phone number

Failure to provide complete documentation will result in the claim being denied.
